Balikatan Cash Loan Agreement

Preamble

 

This Agreement is a legal agreement between you (the "Borrower") and the operator of Balikatan Cash regarding the provision of loan services through the Balikatan Cash mobile application (the "App"). Please read and understand all terms of this Agreement carefully before submitting a loan application. When you click "Agree" or submit an application, it signifies that you have fully understood, accepted, and agreed to be bound by this Agreement.

1. Basic Loan Terms

1.1 Product Parameters

- Loan Amount Range: ₱2,000 - ₱50,000

- Loan Term: minimum 91 days, maximum 180 days

- Annual Percentage Rate (APR): 8% - 20%

1.2 Calculation Example

Loan Amount: ₱20,000

Loan Term: 120 days

APR: 18%

 

Calculation Details:

- Total Interest: ₱1,183.56 (20,000 x 18% / 365 x 120)

- Total Amount Due at Maturity: ₱21,183.56

- Net Amount Disbursed: ₱20,000

- Daily Repayment (amortized): approx. ₱176.53

2. Application and Approval

2.1 Eligibility Requirements

You represent and warrant that:

1. You are a Philippine citizen or legal resident

2. You are between 20 and 65 years of age

3. You have a stable source of income

4. You possess valid identification documents and a bank account

5. You have a good credit record

2.2 Required Documents

- Valid ID (driver's license, passport, UMID, etc.)

- Selfie photo (facial recognition)

- Contact details (mobile number, email address)

2.3 Approval Process

1. After submitting an application, the system will conduct a preliminary review within 5 minutes

2. The approval result will be notified via in-app notification and SMS

3. Upon approval, funds will be automatically disbursed to the designated receiving account

3. Repayment Terms

3.1 Repayment Methods

- Manual Repayment: e-wallets such as GCash, PayMaya

- Over-the-Counter Repayment: partner outlets such as 7-Eleven, Palawan Pawnshop

3.2 Repayment Schedule

- The repayment date is clearly specified in the loan contract

- A repayment reminder will be sent 2 days in advance

3.3 Early Repayment

- Early repayment is allowed at any time without penalty

- Early repayment can be made through the in-app function

3.4 Late Payment Handling

- Please maintain a good repayment record. Late payment will result in penalties.

4. Rights and Obligations

4.1 Borrower Rights

1. Right to Information: the right to know all fees and terms

2. Right of Choice: the right to decide whether to accept the loan

3. Right to Privacy: the right to have personal information protected by law

4. Right to Complaint: the right to file complaints regarding unsatisfactory services

4.2 Borrower Obligations

1. Provide all information truthfully

2. Repay the loan in full and on time

3. Promptly update contact information

4. Use the loan funds lawfully

4.3 Platform Rights

1. Review loan applications

2. Adjust amount and interest rate based on credit status

3. Collect overdue loans in accordance with the law

4. Reject applications from high-risk users

4.4 Platform Obligations

1. Ensure fund security

2. Protect user privacy

3. Provide quality customer service

4. Operate in compliance with laws and regulations

5. Data Privacy

5.1 Information Collected

In compliance with the Philippine Data Privacy Act (RA 10173), we collect:

- Identity information

- Contact information

- Device information

- Credit information

- Repayment records

5.2 Use of Information

Used only for:

- Credit assessment

- Identity verification

- Risk control

- Customer service

- Legal compliance

5.3 Information Protection

- AES-256 encryption for storage

- SSL encryption for transmission

- Regular security audits

- Employee confidentiality agreements

6. Dispute Resolution

Any dispute shall first be resolved through friendly negotiation via customer service channels.

7. Important Statements

7.1 Risk Warning

Borrow with caution. Borrow rationally according to your repayment ability. Late repayment will affect your credit record and may lead to difficulties in obtaining future loans.

We reserve the right to amend this Agreement. Material amendments will be notified via in-app notification. If you do not agree to the amendments, you may stop using our services.

7.4 Effectiveness of Agreement

This Agreement takes effect from the date you click "Agree" and terminates on the date when all principal and interest under the loan are fully repaid.
